Returns

Users who have purchased products on the website newstore.com (hereinafter "Site") may request returns, exchanges, or free repairs, in accordance with the Consumer Protection Law, as follows:

Right of Withdrawal

The User may withdraw from the purchase of products made on the Site within 10 days from the receipt of the product, in accordance with Article 3 bis letter a of Law 12345 on Consumer Rights Protection.

The right of withdrawal cannot be exercised when the item that is the subject of the contract has deteriorated due to the fault of the consumer.

If the User exercises this right, the amounts paid will be refunded without withholding any expenses, as indicated in section VII of these Terms and Conditions.

Legal Warranty

In accordance with Law No. 12345 on Consumer Rights Protection, purchases made from March 24, 2022, will have a minimum legal warranty period of 6 (six) months from the receipt of the product, provided that it has not deteriorated due to the fault of the User. If the product was sold with a specific warranty, the longer of the two warranty periods will apply.

This law states that the consumer has the right to have the product replaced, or, if not, to choose to receive a refund for the amount paid in excess, when the quantity or net content of a product is less than what is indicated on the packaging.

In the cases outlined below, the User has an irrevocable right to choose between free repair of the item, or, upon returning it, having it replaced or receiving a refund for the amount paid, without prejudice to compensation for any damages:

a) When products subject to mandatory safety or quality standards do not meet the corresponding specifications.
b) When the materials, parts, components, substances, or ingredients that make up the products do not correspond to the specifications they claim or the labeling mentions.

c) When a product, due to manufacturing, production, materials, parts, components, substances, ingredients, structure, quality, or sanitary conditions deficiencies, is not entirely suitable for the use or consumption it is intended for or that the supplier has indicated in its advertising.

d) When the supplier and consumer have agreed that the products under the contract must meet specific specifications, and this does not occur.

e) When, after the first warranty has been honored and the corresponding technical service has been provided, deficiencies persist that render the item unsuitable for the use or consumption referred to in letter c). Without prejudice to the above, it will not be necessary to enforce the guarantees granted by the supplier to exercise the right established in this letter. This right will be upheld in the event of a different deficiency than the one that was the subject of the technical service or the reappearance of the same deficiency within the timeframes indicated in Law No. 19,496 on Consumer Rights Protection.

f) When the item under the contract has hidden defects or vices that make it impossible to use it for its intended use.

g) When the law regulating the metal content in gold, silver, jewelry, and other articles is less than what is indicated on the items.

The User, when exercising the rights mentioned above, may contact the seller, manufacturer, or importer, individually or jointly. In the event that, after the repair service has been provided, deficiencies persist that render the item unsuitable for the use or consumption referred to in letter c) above, the User may choose between replacement or a refund of the amount paid. Once the choice has been made, the recipient cannot reject the claim.

The seller, manufacturer, or importer, as applicable, must respond to the exercise of the rights indicated in this section in the same place where the sale took place or at the offices or locations where they typically serve their customers. The exercise of these rights cannot be conditioned on being performed in other places or under less convenient conditions for the User than those offered for the sale, unless the User agrees to it.

The User may choose to exercise the warranty or the other rights mentioned, at their discretion.

In the case of products that have been reported as imperfect, used, repaired, opened, second-choice, remanufactured, with some deficiency, or in whose manufacture or production used parts or pieces have been used, among others, and have been purchased in that condition at a reduced price, no change or sending to a technical service will be possible, nor will a refund be made for legal warranty reasons. However, in those cases, some Sellers may offer voluntary warranties under the conditions they publish on the product page.

Satisfaction Guarantee

The New Store Satisfaction Guarantee allows the User to return their product up to 30 days after receiving it, at no additional cost, at authorized return points, as indicated in the "Returns and Exchanges" section.

The product that the User wishes to return must be, at the time of the return, unused, with all its accessories, original packaging, and all promotional gifts associated with the purchase. If these conditions are not met, the User will not be able to use the benefit described in this clause. Only the cost of the product will be returned, not the shipping cost.

This benefit does not apply to used, refurbished, or second-choice products, or those that have been purchased with a reported deficiency that has resulted in a price reduction.

To ensure the User's safety and that of all New Store customers, the return or exchange of the following items will not be allowed:

Contract Termination and Exercise of Rights

To unilaterally terminate the contract in accordance with this section, the User may use the same means they used to enter into the contract.

In order to exercise the rights and benefits established in this section, the User may: (i) call 123 1234 1234 to have the product picked up at their home, subject to payment of the removal fee, which will be communicated to the User before confirming the return of the product. In case of a return, only the cost of the product will be returned; (ii) deliver the product directly to the locations authorized for this purpose, which are indicated on the Site in the "Returns and Exchanges" section; or (iii) for those purchases made through the New Store Marketplace, the product will be picked up, at no cost, at the same address to which it was shipped, or it will be delivered to the locations authorized for this purpose, which are indicated on the Site in the "Returns and Exchanges" section, or in any branch of our logistics operators.

For these purposes, the User must present their invoice, delivery note, exchange ticket, or any other document that demonstrates the purchase made through the Site. For purchases made through the New Store Marketplace, the User must present the email with the collection ticket or order number. If the customer does not have their invoice or collection ticket, the Customer Service department will assist in locating it. In the case of products marketed by New Store under their own brand, the aforementioned documents are not required.

Cancellation

The cancellation of the order applies only to purchases made through the New Store Marketplace. The User can cancel the order before the Marketplace Seller has accepted the purchase.
